In March 2024, the Atherton City Council adopted an ordinance to update its municipal code regarding accessory dwelling units (ADUs). The 2024 updates focus on two key areas: the Bonus ADU Program and encouraging ADU development that complies with local setback standards. 

The Bonus ADU Program encourages the creation of ADUs for lower-income residents. The updated ordinance also permits ADUs to be constructed above detached garages, when complying with the Town’s existing setbacks. These updates support the Town in meeting its Regional Housing Needs Allocation (RHNA) for the 6th Cycle Housing Element.

These additions to the existing policy were introduced in February 2024 after several discussions with the Planning Commission throughout 2023. Town Planner Brittany Bendix wrote the March 2024 staff report.

“The adoption of the 2024 ordinance reflects the Town of Atherton’s commitment to promoting ADUs while ensuring compliance with state requirements,” said Brittany Bendix. “By adding the Bonus ADU Program and refining guidelines for ADUs above detached garages, the Town is taking the necessary steps to increase affordable housing options and meet its regional housing goals.”
